The Board of Zoning Appeals. meeting last Thursday, voted unanimously to grant David M. Flach a variance to the county’s flood plain ordinance that prohibits issuing permits for buildings, structures or sewage disposal systems located in or within 50 feet of a flood plain boundary.

Flach expplained that he needed the variance before the health department would grant a permit for installation of a septic drain field.

When he purchased the property seven years ago. Flach said, the 60-year old house located on Route 707 near Madison County carried a permit that allowed him to add bathroom facilities. Before he could begin construction, however, the county adopted its zoning ordinance and "the health department permit to put in the septic system was no longer valid." With his variance request. Flach said. "I'm trying to reconstruct what 1 had when I bought the property.”

“Was this property flooded in that recent storm?" asked BZA chairman Josef Gardiner.

"No. it was not." replied Flach. presenting a letter from adjoining landowner and long time resident Charlie Jenkins that stated the nine acre lot hadn't Hooded in his memory.

Restoration Supported

Mrs. Brown Miller, another neighbor, added that the site in question hadn’t Hooded during her 25 years in the area. "No one asked nte to come here." she told the BZA. adding that she was in favor of the granting the variance so restoration work
