In the first variance application a narrow property in a conservation zone would have been unbuildable without the variance. The property is 137 feet wide, and the zoning ordinance requires 100-foot setbacks on either side.
The lots were created before conservation zoning was adopted in the county. Roger Batchelder owned the lot in question and several similar lots in the “Twin Falls” subdivision off Route 629 in the Flint Hill area.
Peter and Martha Snyder had a contract to purchase the lot if they could get the variance. Mr. Snyder said they would build a small two-bedroom house on it and rent the house out.
Variances are issued when they meet the test that prohibiting them would “unreasonably restrict” the use of the property or “create a hardship approaching confiscation.”
All three members had to approve the variance for it to pass, and they did.
