Section 2. From and after the 27th day of June, 1959, the poles and other structures on, along and under the streets, avenues, parks, bridges and other public places of the Town of Washington, Virginia, authorized by this Ordinance to be located and constructed, shall be located at reasonably suitable and convenient points, and permits for the location of poles and other structures shall, from time to time, on application of the grantee, be issued by the Mayor or other proper administrative officer of the Town.

In the event the Mayor or other proper administrative officer of the Town fails or refuses to issue si permit, or permits, designating the suitable and convenient points, the grantee shall have a right to locate, erect, maintain and use the poles and other structures at such points as the grantee deems suitable and convenient. When such permits have been issued, or when .. the grantee, in the absence of permits, has located and erected its poles and other structures, pursuant to its plans, the said permits and plans shall be effective and binding to the same extent as if they were set out fully and at length in this Ordinance.

Section 3. In the location and erection of the poles, conduits and other structures and fixtures, and in stringing the wires, as herein authorized, the grantee shall have the right to trim, cut and keep clear of its wires and fixtures the trees in and along the streets, avenues, parks, bridges, and other public places of the Town of Washington, but shall not cut or otherwise injure said trees to any greater extent than is reasonably necessary in the construction, maintenance and operation of the said poles, wires, fixtures and other structures of the grantee, as herein authorized and provided.

Section 4. Overhead wires are to be used for supplying service under this franchise unless the grantee, in the exercise of the authority hereby granted, elects to place transmission and distribution wires and cables in underground conduits.
