Widows Benefit Law

Under previous laws, once a widow remarried she was no longer entitled to Veterans Administration compensation or pension benefits, unless she obtained an acceptable legal mnulment. Public Law 91-376, approved August 12, 1970, provides some interesting changes in matters pertaining to widows entitlement ;o Veterans Administration >enefits. This section of Public Law 91-376 will become effective January 1, 1971. It simply states that if a widow terminates a relationship for conduct which resulted in a bar to Veteran: Administration benefits, she may once again become eligible tc receive benefits.

If a widow has remarried, and tier Veterans Administration benefits have been terminated then she will once again become eligible for VA payments in the event her husband dies or if she i: divorced from him. Service Officers should keep in mind that this provision does not go intc effect until January 1,1971.

A widow coming under thi: provision cannot receive by having been the legal wife oi more than one veteran, she wil be required to elect the benefit: she desires. There will be n< review on these cases, so they must be brought to the attentioi of the Veterans Administratioi
