vis advised the Board that he didn’t think the County could put any restrictions as to who would have use of the facility on a landfill that was privately owned. Chairman Pete Luke requested advice on another legal question. Could the county renegotiate its three-year contract with Community Trash, once it was in operation, for a longer period of time without going to bids again? Nobody answered his question, but Luke said he thought this was a legally acceptable procedure to follow and one that would not leave the county open to litigation on the part of other contractors.
WHEN asked by Luke if they wanted him to continue negotiations on the present course of action, moving towards a privately owned landfill, the rest of the Supervisors all nodded in agreement. “Let’s go on with this and see how it goes,” said Luke, “We might get burned but I’ll take my chances.”
Luke added that if the initial 90-day time period with Orange elapsed and the Updikes did not have a working landfill, that it might be possible to obtain a time extension for an additional 90 days.
