(Continued from Page 1) During board of zoning appeals hearings on the variance request, the validity of the NPEA’s original building permit was questioned, he noted. When issuing the variance, Konick said, the BZA noted in its order that it lacked the jurisdiction and power to enforce zoning law or lack of validity of the NPEA’s building permit. Konick pointed out that the BZA order held that the supervisors and zoning administrator must determine both the validity of the building permit and a permanent solution to the NPEA campground controversy.

As a result of the BZA’s position, ‘‘we’re asking that the permit be rescinded and declared null and void,’-* Konick told the board.

As grounds for revocation, he maintained that NPEA failed to submit plans along with its permit application, referring to the section of the ordinance which states thit> the administrator may require a scale drawing.

“A lot of information that should have been included wasn’t,” Konick stated.

Facta Misrepresented *

He charged the NPEA with misrepresentation of fact. Konick noted that the organization had identified itself as a church on the building permit application when, according to certification filed by NPEA with the clerk’s office, it is instead an organization of ministers.
