According to Konick's injunction petition, however, NPEA trustee L. D. Savage misrepresented to the health department that daily use of the premises would not exceed four hours per day, from 6 p.m. to 10 p.m. On that basis, Konick noted, local sanitarian M. G. Lockhart issued a permit to install the sewage disposal system.,
Konick asks that the permit be declared null and void on the grounds that (lj no tests were conducted to determine if the NPEA’s water supply is sufdicient for a sewage disposal system for 500 persons and (2) the permit violates health department rules which require filing of plans, specificiations and maps for construction or expansion of any sewage disposal system serving more than 400 persons.
