across the stub of Gay Street, objected to the application, saying it would increase the density in the area to construct a dwelling on such a small lot. The BZA denied the variance application on a four to eight vote with member Mitzie Young abstaining.

Last July Mrs. Eagle applied to the Architectural Review Board for permission to demolish the shed and construct a studio on the lot. Town Zoning Administrator John McCarthy had approved the application for the studio, although it was identical on the outside to the house that had been denied by the BZA, because he considered the studio an accessory use to the house across Wheeler Street. The ARB approved Mrs. Eagle’s plans.

Ms. Bruce appealed by the BZA to overturn Mr. McCarthy’s decision to approve the building as an accessory use, and in October the BZA met and voted unanimously to reverse Mr. McCarthy’s decision.

In November Mrs. Eagle brought suit against the town and Mr. McCarthy claiming that she should not have had to apply for a variance in the first place. There has been no action on the suit.
