A farmer is entitled to consequential damages if his property is damaged by improvements made, even though no actual property is- taken. These two types of damages are handled the same under Federal tax laws.
When damages occur to land not taken by the condemning agency, the burden of proof to the jury rests with the property owner.
However, juries have awarded compensation on this partial list of damages; utility lines including power, telephone or telegraph running under or over property; cost of new fencing; building moving costs; time lost in cultivating or harvesting crops; power lines damaging trees, land cut off from a source of water; crop or livestock damage.
