“It’s not a question of can or can’t,” said Commonwealth’s Attorney Davis. “But you’ve got to be able to take a look at it to see if it’s intended for reselling.”
Newbill Miller elaborated: “There’s a certain amount of risk involved with people trying to subvert the ordinance. This will take care of 90 per cent of the cases, and if it doesn’t, you can always come in and get exceptions.”
Foster still thought three lots was too few, noting that he himself has four children.
“We’ve been debating this,” George Davis said. “Some thought it should be five, some thought two, some thought three. The only question is the number of lots... If it’s a bona fide division, that’s one thing; but if a child wants to re-sell his lot for a subdivision, that’s another thing.”
