property owners to DeMent, petitioned the circuit court to review the BZA’s decision to grant the special use permit, alledging that ordinance restrictions against building in a flood plain had been violated.
On May 12, the BZA found DeMent in violation of the 50 foot setback from the Stuckey property line and on May 17, Zoning Administrator Evan McNear advised DeMent of the violation. Construction of the building continued and on June 9, Josef Gardiner, chairman of the BZA, notified DeMent that the special use permit had been revoked.
This time, it was DeMent’s turn to file a petition for review of the BZA’s decision in circuit court. Rappahannock's Supervisors requested status as parties to the case in September. Their request was granted by Judge Snead on October 10 and the suit filed by the Stuckeys was consolidated in October with the suit filed by DeMent. Circuit Court Judge Rayner V. Snead stated on Wednesday morning that he hoped to make appointments to the School Trustee Electoral Board within a week. Snead expressed appreciation of the interest shown by county citizens regarding the three appointments, adding that he had gained insight from his conservations with people in his offices on Monday.
School Trustee Electoral Board members serve four years and are responsible for the appointment of the Rappahannock School Board.
