The Burton amendment was written, he said, to authorize boundary changes in new parks for ten years and to allow minor revisions of boundaries in older park areas-both without legislative areas—both without legislative action bv Committees with jurisdiction over national parks in the House and Senate were satisfied.
First, said Jacobsen, Shenandoah is not a new park and second, park boundaries would not be altered by the proposed exchange. Jacobsen argued that all land involved in the swap lay within the Park’s authorized and intended boundary so the transaction would only change the ownership of property within that boundary rather than the boundary itself.
Therefore, he concluded, the Burton amendment with its restriction against exchanges of property administered as part of the national park system has no bearing on the proposed swap of Rappahannock park land.
Jacobsen said he expected the Park’s solicter to rule on the issue within ten days or so from last Wednesday and expressed confidence that
