He continued that he had no difficulty with the revocation question. He ruled that the BZA was clearly within its rights in revoking the special use permit. “The ordinance says so,” Snead stated. “It’s not up to the BZA to interpret the ordinance. This is a matter for the courts to do."
Crigler disagreed with the Judge's contention that the BZA had revoked DeMent's special use permit acting in conjunction with the Zoning Administrator. He argued that the Judge would have to listen to the testimony of witnesses before deciding if certain things alledged by the BZA’s attorney did indeed occur. In answer to a question from Snead. Crigler said he wanted to present additional evidence on whether the 50 foot set-back was a condition of the special use permit and whether the breezeway connecting the new structure with the existing building was discussed. "There were witnesses who were here and can testify beyond what is included in the record." he maintained. Over the objections of Biddle, who contended that 15 months should have been enough time for Crigler to gather his evidence, Judce Snead continued the case until November 13 at 2 p.m. "Hopefully, we’ll have a final disposition then," he concluded.
