Davis argued that the Supervisors had not included "’’’any budget items for payment of the BZA's legal fees beyond the $1,800 already paid on account. (He has contended in the past that the Supervisors cannot legally pay the BZA's legal bill beyond the amount included in last year's budget in the BZA account. Col. Luke, on the other hand, has maintained repeatedly that the Supervisors are responsible for any bills that the BZA incurs since it is "a creature'' of the Supervisors.)

The consensus of the Board was to wait until the final charges in the litigation are tallied before taking any action.
