In the petition. Baumgardner states that Article 14-1-3 of the county’s zoning ordinance, which provides that any nonconforming use discontinued for more than one year shall be deemed abandoned and that any subsequent use shall conform to ordinance requirements, is “invalid and inoperative." He maintains that this section, by providing that a landowner loses vested rights to a non-conforming use after abandonment of the use for one year or more, violates provisions of the state enabling act since the enabling act allows up to two year's abandonment before vested rights are lost.
