Hearing January 10
The Ski Corporation's petition to intervene will be heard in Rappahannock Circuit Court on January 10. At that time, the judge will also rule on the county's motion to strike, filed in answer to the Izaak Walton League’s suit on December 7 by Commonwealth Attorney George Davis.
In his motion, Davis maintains that no actual controversy has been shown to exist between the Supervisors and the Izaak Walton League based upon "an actual antagonistic assertion and denial of rights.”
He further argues that the Rappahannock Chapter of the League has no standing and that its claim is based on “future or speculative facts.”
