Sen. Joseph V. Gartlan, D-Fairfax, accused Ms. Dunlop of not adhering to the law in terms_ of enforcement and her role as "secretary, suggesting that if she's unable to do that then "she ought to resign."

A spokesman for Gov. George Allen called the report politically motivated, saying the DEQ has done its job and that fining businesses more would only hurt the state's economy.

"There's little merit in it," said Ken Stroupe, the governor's press secretary. "Their (JLARC) goal is to chase jobs and businesses out of Virgihia."

Sen. Gartlan said federal regulators would be able to do at least as good a job at less cost to Virginia taxpayers. He suggested that if the state can't clean up its act then a different approach in needed.
