Scott sentenced
to pay $500 fine

Having been found guilty of a charge of petit larceny following a jury trial last month, Cecile Scott was sentenced last week in Rappahannock Circuit Court. Scott had been found guilty in General District Court but appealed the case.
Scott was also found guilty by the jury of one charge of stealing $3 from a fund at Rappahannock County Elementary School. When asked by Judge Shore Robertson if she would like to make a statement before sentencing, she thanked the judge and her attorney, Douglas Baumgardner and said, “I borrowed $3 and have no idea why we are here today. It seems silly to me.”
Baumgardner made a motion to set the case aside saying the court had erred in instructing the jury. Commonwealth’s Attorney Peter Luke cited nine cases supporting inference of intent to steal. The judge reviewed the instructions and said i they were correct as read, the jury was able i to weigh all the evidence and found it sufficient to return a verdict. He overruled the motion.
Robertson said, based on all considerations, a fine of $500 would be imposed along with the cost of proceedings. “I realize you maintain your innocence,” he told Scott, “but the matter was completely and fairly tried. Perhaps with your multiplicity of abilities and skills you’ll be able to find some other way to fulfill your desire to work in the area you have talent in, with your music.”
