Bankruptcies won’t blot out back taxes, government fines, alimony or child support, student loans and some other obligations. And since they’re a matter of public record and stay on credit reports for up to 10 years, many people can find out about them, including future employers, banks, finance companies, landlords, car dealers, insurance companies and anyone else consumers solicit for credit.
Even filing may not help people change their financial habits in the end, Richard said. Although the courts are supposed to monitor people who file for bankruptcy for five years, he is not sure that actually happens.
“People ought to be put into classes on spending,” Richard said. That’s the only way they’re going to learn not to repeat the pre-bankruptcy pattern of spending, he said.
Richard should know: In the 1970s, he declared bankruptcy at age 25; after never having paid off the car loan his dad cosigned.
