Defendants.

The object of this suit is to have a sale of the certain tract or parcel of land containing TWO HUNDRED SIXTY-EIGHT (268) acres, more or less, situate, lying and being in Rappahannock County, Virginia, fronting on U. S. Highway 211, adjoining E. M. Schwartz, Amos E. Frazier, M. A. Frazier, Anna Smith Brown, R. Lee Taylor, Brooke R. Miller and others, being the same land devised to Rachel Wood Piehler for life, with remainder to certain of the above defendants, and allotted to the said Rachel Wood Piehler and the said remainder™ en by decree enteied in the Circuit Court of Rappahannock County, Virginia, in the certain chancery ca'-se therein pending under the short style of C. J. Miller, Jr., and others, Executors of the Estate of W. G. Wood vs. Jonas Alther and others; .to commute the life estate of the complainant in the said real estate and in the amount due under clause (12) of the said will, and pay to the said ^complainant a gross sum in cash with the balance to be invested and held in accordance with the terms of the said will; to have the court construe clause (5) of the said will and enter a decree adjudicating and settling its construction, and for general relief.

Arid an affidavit having been made and filed that the defendants, Alcinda Marie Piehler, John Andrews Piehler, Rachel Wood Piehler, Mildred Wood Maney, Robert Earl Maney, Rachel Jeanette Maney, Mildred Earl Maney, and Jacquelin Maney are not residents of the State of Virginia, and . that the unborn children of Rachel Wood Piehler, the *unbom children of Mildred'Wood Maney, the unborn issue of Rachel Wood
