Fruits, berries and vegetables dried naturally or artificially are exempt. Redried tobacco leaf is not. “The re-drying of tobacco simply removes excess moisture so the leaf is safe to store and is no different from artificially drying fruits and vegetables,’’ Maxton contends.
In some cases the decisions are liberal, he points out. In other cases they are subject to question.
Maxton says many agricultural workers believe the question has been settled only temporarily.
Whether or not certain farm products can be shipped by exempt carrier is a question that can mean lots of money to the farmer, Maxton says.
When farmers have to abide by the inflexible ICC regulations, rather than making independent cotracts .with exempt carriers, it frequently means doss of quality and spoilage in the produce— with attendant loss of money, Maxton says.
