THE WARRANTS FOR THE charges were secured by State Police Investigator Thomas M. Galloway who with former Rappahannock Sheriff Charles K. Estes had spent almost two years of intensive investigation.
Twenty-one jurors were summoned and sworn and from these 12 were selected. Mrs. Dorothy Butler was chosen foreman; others were Mrs. E.W. Gore, Dan Jacobs, Mrs. Elizabeth Jacobs, Thomas Eastham, Aubrey North, Irving Sisk, Miss Mary Sue Atkins, Clyde Lillard, Albert Williams Jr., Gene Austin Fletcher and Haywood L. Turner.
After the oath was administered to the Commonwealth’s Attorney’s witnesses, they were excluded from the courtroom and recalled one at a time to testify.
Judge R.V. Snead was on the bench and George H. Davis Jr. is the county’s prosecutor. Edward Greco of Front Royal was the court-appointed attorney for the defendant.
INVESTIGATOR GALLOWAY told of being summoned to the murder scene by Sheriff Estes on the morning of September 20 and upon arrival found the victim still partially in his sleeping bag and his head covered with his jacket. Large gaping head wounds proclaimed his untimely demise.
The back storm door of the restaurant was open and the wooden door pried open and splintered in the process. The cash register and safe were open and empty and the coin box of the juke box was ripped off.
An iron wrecking bar was on the counter along with a tire iron. Pictures of the murder scene, weapons, blood stains were introduced as exhibits along with the lethal weapon.
Dr. Robert L. Cassidy, coroner, testified to his examination of the victim, identified the death certificate and related the findings of the autopsy, and verified that the wounds could be caused by a blunt instrument.
Mr. Estes cor robe rated the testimony given by the investigator and had requested his aid after realizing the seriousness of the crimes.
