In August, 1978, Circuit Court Judge Rayner V. Snead upheld the revocation of DeMent’s special use permit by the county's board of zoning appeals. The BZA had withdrawn its earlier approval in June, 1977, on the grounds that DeMent had failed to comply with conditions attached to the special use permit for the new construction.
By letter dated May. 1979, the BZA gave DeMent 30 days to modify the 70-foot by 40-foot addition to meet requirements set forth in the original permit. When DeMent took no action, zoning administrator Evan McNear first filed and then dropped charges on failure to obtain a building permit. McNear recently indicated, however, that he will again initiate steps to resolve the controversy through legal channels after the first of the year.
