If the school board can call those two documents “working papers of a chief executive officer,” then any report prepared by the superintendent or submitted to him could be kept away from the eyes of the public up until the minute that the report or proposal is finally adopted. That means we can be denied a look at plans for a high school expansion or a proposed budget until after-the-fact, until after approval or rejection.
It is for these reasons that the Rappahannock News is asking the commonwealth’s attorney to take action against what we perceive as a clear violation of Virginia’s Freedom of Information Act. If he doesn’t, the News will proceed with filing a writ of mandamus or injunction against the school board.
We have no other choice.
