In 2001, Mr. Claffy was convicted of involuntary manslaughter in the death of Troy Foster. Claffy was legally drunk when his F-250 slammed head on into Foster’s Toyota pickup on Dec. 21, at the crest of a hill on Resettlement Road just outside of Flint Hill.
As part of the plea agreement, Claffy committed to paying for Foster’s young son, Isiah to go to college. He also served 14 months in jail, was required to do 100 hours of community service and could not reapply for a driver's license for 10 years.
Commonwealth Attorney Peter Luke, who prosecuted Claffy, said “You would hope he would do the right thing and take care of that family” when asked for comment yesterday.
Foster's parents, Mary Ellen and Jimmy Foster - who lived on Dearing Road at the time - could not be reached for comment.
