S.W. of a large Sassafras Tree; thence, along the rail fence, N 21 l/2 W 12.5 ch. to “4”, a stake in a pile of stones; thence, leaving rail fence, S 88 1/4 W 6.1 ch. to “3”, a stake in a pile of rocks at the S.W. corner of Bruce’s garden; thence N 15 W 1.8 ch. to “2”, a stake in a pile of stones at the corner of Bruce’s yard; thence N 7 E 6.6 ch. to the beginning and containing 145 ACBES more or less.”
The above descirbed tract or parcel of land is the same land devised by W. G. Wood to Solomon Bruce for life with the remainder to those persons who may be the heirs of Solomon Bruce at the time of the death of Solomon Bruce, and is the same land set off unto said Solomon Bruce and Us heirs by partition in the Chancery Cause of C. J. Miller, Jr., et als. vs. Jonas Alther, et al, being Chancery File #1997 in the Circuit Court of Rappahannock County, Virginia.
The right of way to the 145 acre tract of land hereinbefore described, across the lands of Jonas Alther, is set forth as follows:
-“Beginning at ”2” on plat, a stake in a pile of rocks corner to Solomon Bruce and Jonas Alther at the North West corner of said Bruce’s yard and running with an old rock fence, S 86 1/4 W 9.2 ch. to a stake at the East side of a gap in the rock fence; thence N 78 1/4 W 6.3 ch. to a point in the rail fence; thence, leaving the fence, N 32 W 2.65 ch.; N 3 W 1.8 ch. to a point in the Alther-Hildrup division line 0.62 ch. from “M” on the plat an iron pipe in a pile of stones.
The above description is of the Right of Way’s left boundary line and said Right of Way shall be TWENTY (20) FEET wide.”
The 145 acre tract of land hereinbefore described will be sold subject to any rights of way thereon.
TERMS OF SALE: Said sale is to be made for cash and immediately after the time of purchase, the successful Udder or bidders shall make a deposit of 10% of the purchase price of said tract to the credit of this Court in this cause in the Farmers and Merchants National Bank of Winchester, General Receiver of this Court, and the receipt showing said deposit shall then be forthwith delivered to the Special Commissioner herein.
