At this point, Luke stopped mentioning an executive session. He maintained that the correct procedure to follow would be to wait for “due process’’ and a decision on granting a special use permit from the Board of Zoning Appeals.
“Then I suggest the Supervisors stay neutral and let the landowner back the Updikes in their request for the permit,” said Mrs. Helmer.
“We can’t stay neutral,” responded Luke. Without the special use permit, there would be no landfill, no place for trash, the dumpsters would be removed and there would be no trash service at all, he said. The alternative is a public facility, but “we don’t want to get into condemnation,” Luke concluded.
Carson Johnson again disagreed. Regardless of the site characteristics, if the land is available, away will be found to approve it, Johnson agrued. If the soil doesn’t have the minimum workable depth, then a trash mountain will be built. “That’s why I think the county should find the best location. If we have to spend $40,000 for trash disposal, let’s get our money’s-worth. In my opinion,” he added, “we’re not getting our money’s worth.”
SUPERVISOR E. B. Wood noted that people, not the contractors, were responsible for the mess at the dumpster sites.
‘ ‘This contract is for three years at $32,600.16 per year,” said Luke. “We’re not paying any additional for the landfill. ”
“What happens after the three year contract is up?” asked Patricia Helmer.
The county can buy a landfill site in the meantime or contract with a company who will dispose of Rappahannock’s trash at a location outside of the county (“If they can find one,” interjected Davis.)
