Patricia Helmer repeated her objections to an executive session on the subject, maintaining that it would only serve to “rubber stamp” Luke’s opinions presented at the October 21 hearing of the Zoning Appeals Board. Luke claimed that this was prejudgement on Mrs. Helmer’s part.
She disagreed. “I was at that meeting and I saw how upset you were,” Mrs. Helmer told Luke. (The BZA hearing was adjourned without reaching a decision on the special use permit after Commonwealth’s Attorney George Davis and Pete Luke asked that the Rappahannock Supervisors be made a party to the application with the Updikes. Members of the BZA wanted advice from counsel as to whether the application could be amended without readvertising. At this time, the BZA hearing on the landfill has not been rescheduled.)
Luke returned to the executive session question. He maintained that the landfill issue involved a “private person and their money,” and therefore justified an executive session.
Mrs. Helmer wasn’t finished arguing for a public landfill.
