"That don’t sound right, Goode complained. “Thre’s no way, unless the land is perfectly flat, that we’re going to be able to do that,” Mrs. Goode agreed. “There is a way but you’re probably going to have to adjust the number of lots,” answered Luke.
“I made adjustments. 1 took out one lot (because of slope). Then you did a reverse on me,” Goode argued.
“This is the first time this plat has come under consideration by this board," Luke said, emphasizing that the supervisors’ public hearing in August, 1977, had concerned Goode’s rezoning application only and not a preliminary or final plat.
"In the past, there’ve been only one or two people in your favor,” said the supervisor chairman. "If you make these adjustments, 1 think that everyone will go along with you . . . It’s a compromise. If you don't agree, you’ll have to take it through the • court," Luke told Goode.
“There are more votes involved than mine,” he continued. “Either you do something to get them or you don’t. It's up to you.”
“There’s information in this court house that states that none of these lots are in excess of 14 percent," interjected Mrs. Goode.
“Our information came from our county engineer,’’countered Luke, describing Baumgardner as a “registered professional...a very capable guy."
Even if Baumgardner’s figures showing one fiVe-acre lot with 40 percent of its area over 14 percent slope are correct, “that still leaves three acres under 14 percent,” argued Compton. “You can put your building site there, your drainfield there, and the rest won't be disturbed."
