Luke repeated that Baumgardner was a qualified, professional engineer with wide experience. The compromise requiring additional protection against erosion and stipulations that each lot to have five acres under 14 per cent slope was “the best course of action to uphold the zoning ordinance and give you your rights," he told Goode.
The developer replied that his engineers and Baumgardner "should go out together (to the subdivision site) and work this thing out."
“We have no objections to that.” Luke responded, adding that Goode had 30 days in which to bring his revised subdivision proposals back to the board for action.
“There’s no way I’m going to keep coming back here," Goode countered. “Shis county as a whole don’t w^jt no subdivisions, don’t want no growth. 1 have a certain number of rights and I’m not getting them from this county," he concluded.
Later, Compton guessed that the requirement for each lot to contain five acres under 14 per cent slope would force Goode to delete two more lots, bringing the total in the proposed subdivision to 12. Compton predicted his client would find that the smaller subdivision wasn't economically feasible and would therefore proceed with the court suits, scheduled for hearing on March 12.
