Commonwealth’s attorney Douglas Baumgardner explained that Virginia law confers authority to grant a variance. “Nothing can change the BZA's power to issue a variance except a change in law by the General Assembly."
He added that the planning commission cannot legislate or enact an ordinance that would prohibit, under all circumstances, anything but houses in a residential subdivision zone.
