The Board of Supervisors is in receipt of a letteinfeem-'fne Commonwealth’s Attorney dated November 23, 1984, requesting retro-actively the $8,000 currently in the budget for legal expenses. He also requests permission to charge the county $50 per hour hence forth for the duties of County Attorney in the future.
Mr. Luke further documented that |f this had been done in 1984, he should have received on the order of $18,000 above and beyond his current salary. It is in response to the gravity of this request, and the fact that it was scheduled to be discussed in executive session, that I rose on a point of order at our last meeting to request that this, being clearly a budget issue, be discussed in open session.
My prepared statement below deals with this letter directly, so it may be necessary to obtain a copy of this letter to fully understand my statements below.
Regarding our Commonwealth’s Attorney’s letter dated November 23, 1984: As you (Luke) stated in your letter, the law states that the Commonwealth’s Attorney in counties of less than 15,000 residents shall serve as County Attorney. I feel the reason for this is to justify the fact that they were taking control out of the hands of local governments, and setting your salary as a matter of law.
