Luke disagreed, saying that all the owner had to do was to satisfy the findings. "I don’t think that they should have to say that it’s an absolute necessity for their business to have a caretaker,” Luke said.
The tie vote had to be broken by Bird. He cast the deciding negative vote because he said that in his view the apartment was not a dwelling intended for a caretaker.
The BZA members then disapproved the special use permit application on the grounds that the board could not make finding number four. The vote was again three to two.
