Whippoorwill Associates also wanted to guarantee that the dwelling to be constructed on the property be“compatible with the original construction of dwellings in the general vicinity” by requiring their approval of the home’s design prior to its construction.
BZA members discussed the suit in closed session with County Administrator John McCarthy at the end of their January meeting.
The BZA did not have to do much other work this month because all the applications before it had been withdrawn at the applicants’ request before the meeting.
They did elect officers for the current year: L. G. “Butch” Zindel as chairman, Sidney Gottlieb as representative to the Planning Commission, and Ronald Tokash as vice chairman. Mr. Tokash was not present at the meeting. Outgoing Chairman Lee Bird said his term would be up in October, and he does not wish to be reappointed. The fifth member •fif the BZA, James Swindler Jr., also has a term that is over in October. H4' Was not present to say if he was interested in another term.
When the nominations for officerswere first made by Mr. Zindel, he nominated himself for the Planning Commission seat and Mr. Gottlieb for chairman, but then he discovered that his position as president of the Ruritans conflicted with Planning Commission meetings, so he and Mr. Gottlieb switched positions for 1990.
The BZA also approved a $3,800 budget for 1991, an increase of $500 over the current budget. Of the increase, $400 is for advertising, up from $1,500 this year to $1,900 next year, but this expense is covered by
