NOTICE OF SALE

Pursuant to a decree of the Circuit Court of Rappahannock County, Virginia, made and entered on the 13th day of July. 1998, in the partition suit brought by Jessie L Dodson Pennell, et al. against James Russell Hawkins, and others. Chancery No. 95CH-57, we will on September 8, 1998, at the front door of the Court House in Washington, Virginia, at 11:00 A M. on that day, offer for sale to the highest bidder, a certain tract or parcel of land containing 55.51 acres, more or less, in Hampton Magisterial District, Rappahannock County, Virgimq, which said tract of land lies on the southerly side of the road leading from "Five Forks" to Sperryville, and is bounded by other land of William Jackson, the land of Ashby Sisk and said road, and the road leading from Woodville to ‘Five Forks", together with all improvements situated thereon and all privileges and appurtenances therewith connected. Said tract is more particularly described in a certain deed fromWilliam Jackson and Ella Jackson, his wife, to John M. Dodson, dated and recorded December 25. 1925, in the Clerk's Office of the Circuit Court of Rappahannock County, Virginia, in Deed Book 33, at page 229; and in Deed Book 89, page 44.

TERMS OF SALE: A bidder’s deposit of $10,000 00, said deposit being due and payable on the date of sale in cash or equivalent funds with the balance of said purchase price being due and payable, in full, thirty (30) days from date of sale THIS SALE IS SUBJECT TO THE APPROVAL OF AND CONFIRMATION BY THE CIRCUIT COURT OF RAPPAHANNOCK COUNTY, VIRGINIA. Settlement and compliance with the terms of sale to be had and complied with within thirty (30) days of the date of sale. In the event of default by the purchaser, the Court reserves the right to declare a forfeiture of the deposit, keep the deposit, and readvertise and re-sell the property at the risk and cost ol the defaulting purchaser.
