The object of this suit is to have a sale of five (5) acres of the 375 acres of land allotted to Mildred Wood Maney and certain of the other defandants in the cause of C. J. Miller, Jr., et al. V. Jonas Alther, et al; to have the written offer of $500.00 cash for the 5 acres made by George W. Wood accepted; to have the life estate of Mildred Wood Maney in the said five (5) acres commuted and paid to her in a gross sum in cash, and have the residue invested and held in accordance with the terms of the will of W. G. Wood; to have Clause (6) of the said will construed by the Court and a decree entered adjudicating and settling the construction of Clause (6) of said will, and for general relief.

And - an affidavit having been made and filed that the defendants Rachel Wood Piehler, Alcinda Marie Piehler, an infant, John Andrews Piehler, Mildred Wood Maney, Robert Earl Maney, Rachel Jeanette Maney, an infant, Mildred Earl Maney, an infant, Jacquelin Maney, an infant, are nonresidents of the State of Virginia, and that the unborn children of Rachel Wood Piehler, the unborn children of Mildred Wood Maney, the unborn issue of Rachel Wood Piehler, the unborn issue of Mildred Wood Maney, the unknown heirs of Rachel Wood Piehler, the unknown heirs of Mildred Wood Maney, the unknown heirs of Alcinda Marie Piehler, the unknown heirs of Rachel Jeanette Maney, the unknown heirs of Mildred Earl Maney, ^he unknown heirs of Jacquelin Maney, the unknown heirs of the unborn children of Rachel Wood Piehler, the unknown heirs of the unborn children of Mildred Wood Maney, persons unknown or persons yet to be born or created
