prove the truth of his story, but as in the Zenger trial: the court held it was not for the jury to decide “whether (Croswell’s story) was true, or false, or malicious.”
Croswell was convicted in 1803, but Alexander Hamilton had made such a stirring speech on his behalf that no effort ever was made to jail him.
The €roswell trial resulted in the New York Legislature’s passage of a law* in 1805 accepting truth as a defense against criminal libel" when published with good motives and for justifiable ends.
The law also gave juries in libel suits the right to determine both the law and the fact at the direcion of the-* court. These were principles, remember, argued for in the Zenger case.
In the years 4hift followed, the courts over the growing United States held that freedom of the press included the right to publish without prior censorship — Federal, State or municipal.
Several municipalities tried however, to restrict newspapers. One was Sequin, Texas, (which declared the Sunday Sun a public nuisance and prohibited its circulation in the city.
A court lashed out at the town in 1833 and held it violated the Bill of Rights.
