15. Every vehicle operated or moved upon a highway within this county shall at all times be equipped with such lamps as are required for different classes of vehicles, in accordance with the regulation provided by the laws of the State of Virginia, which lamps shall at all times be capable of being lighted, except as provided by the laws of the State of Virginia, but this section shall not apply to any vehicles for transporting well-drilling machinery licensed under the laws of, the State of Virginia, when operated only between the hours of sunrise and sunset.
16. Every motor vehicle when operated upon a highway shall be equipped with brakes adequate to control the movements of, ■and to stop such vehicle, and such brakes shall be maintained in good working order and shall conform to the regulations provided by the laws of the State of Virginia.
17. Every motor vehicle being operated upon a highway in this county shall be equipped with steering gear adequate to ensure the safe control of the vehicle, which shall not show signs of weakness or breaking under ordinary conditions.
, Every motor vehicle, trailer, or semi-trailer operated upon a highway shall be equipped with a horn in good working order, capable of emitting sound audible under normal circumstances over a distance of not less than two hundred feet.
19. It shall be unlawful for any vehicle to be equipped with, or for any person to hse upon any vehicle, any siren, exhaust, compression or spark plug whistle or horn. It shall be unlawful for any vehicle to equipped with, or for any person to use, any horn or warning device while upon a highway that is not of a type that has been approved by the Superintendent of the Department of State Police, or for any person at any time to use a horn otherwise than as a reasonable warning, or to make unnecessary or loud or harsh sound by means of a horn or other warning device except that the vehicles of common carriers or extra-ordinarily large and heavy vehicles may be equipped with such types of warning device as the Superintendent of the Department of State Police may require or permit.
20. No person shall drive a motor vehicle upon a highway unless such motor vehicle is equipped with a muffler in good working order and constant operation to prevent excessive or unusual noise, annoying smoke and escape of excessive gas, steam or oil. All exhaust pipes carrying exhaust gasses from the motor shall be directed parallel with the ground, or slightly upward.
21. It shall be unlawful to sell or offer for sale a muffler without interior baffle plates or other effective muffling device, commonly called gutted muffler, muffler cutout or straight exhaust, or for any motor vehicle to be equipped with or for any person to use such a gutted muffler, muffler cutout or straight exhaust, while such motor vehicle is being operated upon a highway. >
22. It shall be unlawful, and constitute a misdemeanor, for any person to violate any of the provisions of this ordinance.
23. Any person convicted of a violation of any of the provisions of this ordinance shall be punished by a fine not to exceed three huudred dollars ($300) or by imprisonment in jail not to exceed thirty (30) days; or by both suoh fine and imprisonment.
24. If any section, or part of a section, of this ordinance is hereafter held by any court of competent jurisdiction to be unconstitutional and invalid, such decision shall in no wise affect or render void the remainder of this ordinance.
25. Trial of all violators of this ordinance shall be had by Proceedings before the County Court of Rappahannock County in Mke manner and with the right of appeal as is provided in misdemeanor cases.
26. EFFECTIVE DATE: This Ordinance shall be effective on ahd after 12:01 A.M. on October 4th, 1962.
27. PUBLICATION: The Cleric is directed to publish the foregoing Proposed Ordinance, together with notice of the Board’s intent once a week for 2 successive weeks in the Rappahannock News, a weekly newspaper published at Washington, Virginia in
county of Rappahannock as required by Section 15-8 of the 1950 Code of Virgin^ as amended. >
