had jurisdiction to hear the bki Corporation’s request for a special use permit to build an Alpine Slide. His ruling contradicts George Davis’ argument that the Ski Corporation could build its Alpine slide by right with only a building permit. While Penn could conceivably amend his ruling after further study of the county’s zoning maps and ordinance, his opinion stood at the time the Supervisors issued the building permit to the Ski Corporation.
It’s curious to note that Attorney Douglas Baumgardner, representing the Ski Corporation at the August 3 Board meeting, stressed that his client wasn’t asking that the permit be immediately approved.
However, a majority of the Supervisors felt compelled to go ahead and issue the building permit anyway even though Baumgardner noted that the Ski Corporation wouldn’t act on it until after the ordinance amendments were considered.
For the sake of appearances, the Board should have waited. At least then, the Supervisors would have presented the semblance of going into the hearing on the ordinance revisions with open minds to hear what county citizens had to say.
