Commonwealth's attorney Douglas Baumgardner explained that the supervisors can only prohibit dogs from running at large, defined as being when the animal is roaming, self hunting or not under the direct control of the owner.
Baumgardner also noted that fox. raccoon and deer hunters may go on prohibited land to retrieve their dogs as long as they aren’t armed. "The board is familiar with other options for controlling guns carried in motor vehicles." he added.
Keira. who has been in recent contact with the Game Commission, countered that the supervisors can only regulate hunting with dogs outside of the season. The Game Commission has sole authority to allow or not allow running deer with dogs during the deer season, he said.
