The county scored a victory for the integrity of its zoning and subdivision ordinances last week with the application for a special use permit from Massanova Pentecostal Church for its Christian day school. Initially, the pastor of the church refused to apply for the permit on the grounds that the school was an integral part of the church ministry permitted as a non-conforming use since Massanova existed prior to the adoption of the zoning ordinance in 1073.

But new zoning administrator David konick persevered, relying on both his knowledge of the law and an opinion from commonwealth’s attorney Douglas Baumgardner that a special use permit was legally required for the school’s operation.

Their persistence is in sharp contrast to past policy which—for a variety of reasons—let zoning violations go unpursued.

Now it’s up to the board of zoning appeals to judge the special use permit application under the terms set out in Article’10-13 of the zoning ordinance. I poll rev iew of those terms, we feel
