Thursday that their verdict was the result of misdirections from Judge Shore Robertson in his hour long instructions on the law before deliberations began.
In the trial, testimony came from medical experts, friends and relatives, business associates and acquaintances of the 76-yearold ex-Marine.
“Witnesses” at Thursday’s hearing were legal authorities and supreme court justices, most long dead, who were cited in a lengthy list of legal precedents and case law.
Before beginning his arguments. Konick asked Robertson to set aside the verdict and order a new trial if the judge saw grounds for a reversal rather than waiting for the appeal process to take the issue before the Virginia Supreme Court, an avanue that might take as long as two years.
"We have a number of witnesses who are very old...who may not oe with us if we have to go to Richmond for a ruling." Konick said.
Great Weight
Addressing Robertson's instructions, Konick pointed out that (he court had (old the jurors that they could give great weight to the testimony of the attesting witnesses, nurse Georgia Liston Dailey and Sgt. Edward Stevenson, who witnessed the colonel’s will signing.
