Zoning administrator David Konick questioned whether CenTel qualifies for a variance to setback requirements since Metcalfe— not the utility—is the property owner. “This case arises under some very peculiar circumstances,” he continued. According to Konick, the contractor called the zoning ordinance on a Thursday and was told he needed a building permit before proceeding. “He came in the following week but in the meantime, he had already poured the concrete pad.” As part of building permit application process, it became apparent that a special use permit and variance were also necessary to meet zoning regulations, Konick said.
In order to qualify for a variance, the property owner must show that strict application of the ordinance will work a hardship approaching confiscation, the zoning administrator noted. “This is not the property owner coming in. This is CenTel.” In addition, the applicant “must come in with clean hands...
