Without further discussion the Commissioners agreed to forward the matter to Doug Baumgardner, the Water and Sewer Authority’s attorney.
Reached by phone, Baumgardner said he would submit to the Board of Supervisors drafts of amendments to the present zoning ordinance that he hoped would resolve the matter. Baumgardner also said he had sent copies of the letter from the Federal Agency to all members of the Water and Sewer Authority.
Mobile Home Legislation
The Planning Commissioners on January 16 also discussed proposed legislation that would grant the same status to mobile homes as to site built homes.
The bill, now before a special subcommittee of the General Assembly, states that “mobile homes constitute an increasing and substantial percentage of the new dwelling units in this State,” and that “they provide a valuable housing resource in meeting the State’s need for decent, safe and affordable housing, and that their availability as such housing should not unreasonably be limited by local zoning regulations.”
Zoning Administrator David Konick advised the Commissioners that this bill, if passed, would make the present zoning ordinance invalid. Konick said that the bill, once it is in final form, would have to pass from the special committee to a regular committe of the General Assembly by February 4. Then it would be forwarded to the General Assembly. Konick told the Commissioners that if they or the Board of Supervisors wanted to pass a resolution opposing or favoring the bill, it would have to be done soon.
Can’t Be Restrictive
The proposed bill state? “A zoning ordinance may require that a mobile home be located and installed accord ing to the same standards...which would apply to a site-built home... but under no circumstances shall conditions imposed on mobile homes be more restrictive than those imposed on sitebuilt dwellings. ”
The bill does allow for “reasonable ■ conditions" to be placed on the “aesthetic appearance of the mobile home...” Dick McNear, a professional planner, who attended the meeting, cited three possible aesthetic requirements: l)roof pitch 2)length-width ratio and 3)exterior materials.
