Rappahannock News Staff Writer , The county Board of Zoning Appeals again turned down a variance request last Wednesday, but by Monday the issue was moot.
According to County Administrator John McCarthy, John and Helen Dixon had requested a variance from the zoning requirement that construction for a pond not disturb land within 100 feet of a property line without the neighboring landowner’s written permission. The Dixon’s property is off Route 642 near Viewtown.
William Parish, the neighboring property owner, had not given written permission. However, the pond was already under construction, including earth disturbing activities within 100 feet of the property line, JMr. McCarthy said.
Mr. Dixon testified that the pond, as originally planned was well back from the 100 foot line and its construction would not have required disturbing earth within that line. Construction on the pond started last summer. Mr. McCarthy said Mr. Dixon testified that the priginal contractor “bungled the job.”
A representative from the Culpeper Soil Conservation District recommended that because the soils used in the dam were “marginal,” the dam be built to a 4 to 1 slope rather than a 3 to 1 slope, Mr. McCarthy explained. “That brought the toe of the dam closer to the neighWoodward

Navy Petty Officer 3rd Class Brian P. Woodward, son of Thomas W. Woodward of Viewtown recently deployed with 3rd Battalion, 2nd Marine Regiment, Camp Lejeune, N.C. for six months to the Western Pacific. The battalion will be based in Okinawa, Japan, while conducting short training exercises in other areas in the region.
Woodward is a 1986 graduate of Culpeper County High School and a 4989 graduate of Germanna Commu•nity College.
