After agreeing to modify its rules of procedure “in response to issues discovered in the Bardo litigation,” the Rappahannock County Board of Zoning Appeals (BZA), in closed session, decided against continuing its appeal of the November Circuit Court decision that overturned a BZA ruling against Bardo Brewery.
The disagreement with Bardo surfaced when Zoning Administrator John McCarthy ordered that sales of beer at the brewery be. stopped, because such sales were not in accordance with the Zoning Ordinance; that the brewery was originally permitted if “There will be no sale of products on site, at this time; and the grain residue will be fed to cattle or other livestock.”
Bardo’s owner, William Stewart, appealed the Zoning Administrator’s decision before the BZA on Feb. 27 of last year, contending that his brewery was analogous to a farm winery
