Appeal dropped
The BZA initially decided to pursue an appeal of the Circuit Court ruling, but the prospect was dropped with the decision made at their Jan. 22 meeting.
The revisions to the BZA’s rules of procedure though, according to County Attorney Peter Luke, “make the appellant narrow the scope” of any appeal of a BZA decision, and would thus make it less likely that an appeal such as Mr. Stewart’s would succeed.
The county also recently amended both the Zoning and Taxation chapters of the County Code to in an attempt to minimize the impact of operations such as Bardo, and to establish license taxes for any County business engaging in brewery, winery or distillery activities.
Other actions
Other items before the BZA included:
• The election of officers for 2003, naming Alex Sharp as Chairman, Robert Weinberg as Vice-Chairman, and Jennifer Matthews as Planning Commission Representative;
• The approval of the application by Armin and Johanna Fidler for an efficiency apartment on their Fodderstack Road property in Washington.
