If the zoning laws are Rappahannock County’s comprehensive plan, then Masterson felt special care should be exercised regarding the setting of precedents.

“EVERY record in the Zoning Office is public,” replied McNear. “The Board has access to them at any time. There’s no way I can sell the county short. The ordinances are more than adequate to protect the county from me ‘going off.’”

McNear added that every citizen has the right to appeal any zoning decision to the Board of Zoning Appeals, but that in his nine years as Zoning Administrator, no one had availed themselves of this right. “We make very few judgement calls; we go strictly by the regulations,” said McNear.

Under County ordinances, the zoning administrator can approve up to five divisions of land on his own, unless the divisions come under the subdivision ordinance. If a development meets the definition of a subdivision, then the Planning Commission holds a public hearing and recommends the appropriate action — approval or disapproval — to the Board of Supervisors.
