McNEAR answered that he checked all the land transactions, printed every two weeks in the Rappahannock News, and if the parties involved had not talked to the Zoning Office, he got in touch with them.
Baumgardner asked why the zoning office was no longer routinely notified of all land transactions. Luke explained that the State Attorney General had recently ruled that selling a piece of land was not a zoning matter and did not have to be approved by any county office. Therefore, the zoning administrator was not involved.
“What we want is feedback so we can see how effective the ordinances are,” said Allen Stokes.
“Anything you want to know, I’ll give it to you,” replied McNear. He suggested that the Planning Commission pick up the files from the zoning office before each meeting. The Planners agreed but decided that they also wanted some statistics. They voted to write the Board of Supervisors a letter detailing the information wanted from the Zoning Administrator for the record.
LOOKING ahead to the update of the zoning ordinances required in two years by state law, Luke asked McNear his opinion of the uses-by-right provision of the ordinance. (Each zoning category includes a number of land uses that are allowed by right without the approval of the Zoning Office, Planning Commission or Board of Supervisors.) Luke said he had a “gut feeling” that the ordinances should be changed when updated to include only a few uses by right.-He felt most of the uses by right allowed now should be put in the special use permit category in order to give the county authorities more control, particularly over home businesses.
