on which he based his actions. Section 15.1-550, dealing with procedure for allowance of claims, states that the Commonwealth’s Attorney “shall resist the allowance of any claim which is unjust or not before the Board in proper form.”
When any claim considered unjust or improper by the Commonwealth’s Attorney is allowed by the Board, then the attorney is authorized to appeal the Board’s decision to the circuit court.
THE mimeographed sheets contained a notice, printed in bold face type and capital letters, informing the Supervisors “that when any claim by the Sheriff’s Department has been allowed by the Board against the County, which in the opinion of the Commonwealth’s Attorney for the Commonwealth, is improper or unjust, he will institute proper proceedings in the Circuit Court against the Sheriff and the individual supervisor voting in favor of such improper claim for recovery thereof..
Davis’s notice concludes by stating that his office “will assist the Board of Supervisors with respect to auditing the sheriff’s accounts and will cooperate with the Sheriff with respect to proper filing of his mileage claims.”
